A. ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR WIN THE SKEE-BALL PRIZE GIVEAWAY (hereinafter collectively referred to as the “DRAWING”). OVERALL ODDS OF WINNING DEPEND ON TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED. The DRAWING is open only to individuals who are eighteen (18) years of age or older at the time of entry. Only residents of the State of Wisconsin are eligible. For the purposes of eligibility, a resident of the State of Wisconsin is defined as a person whose primary residence is within the State of Wisconsin. Employees of the Wisconsin Lottery (the “Sponsor” or “Lottery”), and the Secretary, Deputy Secretary, and Executive Assistant of the Wisconsin Department of Revenue, and their immediate family members as defined in s.19.42(7) Wis. Stats. are not eligible. The DRAWING is subject to all applicable federal, state and local laws, rules and regulations. The DRAWING is void where prohibited or restricted by law, rule or regulation. .
B. HOW TO ENTER: The DRAWING period begins at 8:00 A.M. Central Time (“CT”) on August 9, 2019 and ends at 11:59:59 P.M. CT on October 8, 2019 (“Entry Period”). The only way to enter is online. No other method of entry will be accepted. Limit one (1) entry per person per day.
To enter the DRAWING, an entrant must go to www.wilottery.com during the Entry Period, and click on the SKEE-BALL banners, buttons and/or links to access the online entry form for the DRAWING. By successfully transmitting a completed online entry form as directed, the entrant will be entered in the DRAWING. Entrants must fully complete and submit all non-optional data requested on the online entry form, including, but not limited to, full name (complete first and last name) and proper shipping address within the state of Wisconsin, in order to be eligible. Incomplete entries are void. Online entrants to the DRAWING will be given the option to join the Wisconsin Lottery Players Club ("Players Club"); however, eligibility to participate in the DRAWING is not dependent upon entrant’s consent to join the Players Club.
C. METHOD OF SELECTING WINNERS: Winners and alternates for the DRAWING are selected by one (1) or more random drawings conducted by the Wisconsin Lottery.
The DRAWING consists of one (1) drawing to be held on October 10, 2019. The DRAWING date may be changed by the Lottery Administrator to meet the operational needs of the Lottery.
All prizes will be awarded but are limited to one (1) per person. Once an eligible DRAWING entry has been drawn for a person, any subsequent entries drawn for that same person will be disqualified.
In the DRAWING, there will be two (2) eligible entries drawn at random, with the order in which the entries are drawn being documented. The first eligible entry drawn shall win a Nintendo Switch with a $20 Nintendo gift card redeemable for a copy of the Skee-Ball electronic video game. The second eligible entry drawn shall also win a Nintendo Switch with a $20 Nintendo gift card redeemable for a copy of the Skee-Ball electronic video game (See section 3.D for prize details.)
After the initial drawing of the two (2) winning entries is held, forty (40) additional eligible entries will be drawn as alternates (“Alternates”), with the order in which the entries are drawn being documented. If an entry for the DRAWING is disqualified or a prize is forfeited, an Alternate will be awarded the applicable prize. The order in which the Alternates are drawn shall determine the order in which an Alternate will be awarded a forfeited prize or a prize from a disqualified entry. The order in which a specific prize is forfeited or disqualified, regardless of the type of prize, determines the order in which it is awarded to the next Alternate.
No more than one (1) individual person may win a DRAWING prize. No groups or entities (other than one individual person) may claim a DRAWING prize or any portion of said prize. Any entry in which a sole person cannot be determined from the information provided on the completed online entry form will be disqualified.
D. PRIZES: No fee or payment, including the shipping fee, is required to receive a DRAWING prize. All other costs and expenses associated with prize acceptance not specified herein as being provided are the sole responsibility of each winner. The winner is fully responsible for any and all applicable federal, state and local taxes.
DRAWING prizes are non-transferable and non-assignable, with no cash redemptions except at Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value at its sole and absolute discretion.
The "Nintendo Switch" prize shall consist of one (1) Nintendo Switch 32GB Gaming console and one (1) $20 Nintendo gift card redeemable for a copy of the Skee-Ball electronic video game. The total value of the "Nintendo Switch" prize is three hundred and twenty dollars ($320).
The decisions of Sponsor are final and binding on all matters relating to the Drawing.
E. NOTIFICATION AND PRIZE DELIVERY: A list of DRAWING winners will be accessible through the Wisconsin Lottery website as soon as reasonably possible after the drawing is held.
Prizes will be mailed or shipped to the winners by the Wisconsin Lottery (Wisconsin Lottery, 2135 Rimrock Rd. Madison WI 53708-8941) as soon as reasonably possible. Delivery dates are scheduled and subject to change at the Lottery’s discretion. The Lottery and each of its respective agents and representatives are not responsible for loss, theft or delay of any DRAWING prizes associated with the DRAWING once the DRAWING prizes have been mailed or shipped.
The DRAWING prizes will be mailed or shipped to the address used by the winner in his or her online entry. In the event that a DRAWING prize cannot be successfully delivered to that address, such potential winner will be disqualified, the DRAWING prize will be forfeited, and an Alternate will be awarded the DRAWING prize.
Any prize that remains unclaimed after one hundred eighty (180) calendar days after the DRAWING on October 10, 2019 will be considered permanently forfeited, and no further Alternates will be awarded any unclaimed prize.
F. WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the DRAWING and claiming a DRAWING prize, each entrant agrees to (i) be bound by these Official Rules, including all entry requirements, and (ii) waive any and all claims against the State of Wisconsin, Wisconsin Department of Revenue, Wisconsin Lottery, Pollard Banknote Ltd., Bay Tek Entertainment, Alchemy3, LLC and each of their respective affiliated companies, parents, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the DRAWING, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the DRAWING or from the receipt or use of any DRAWING prize or activity related to the receipt or use of any such DRAWING prize. By acceptance of the DRAWING prize, each winner grants to the Lottery and each of its respective designees the right to publicize such winner’s name, address (city only), photograph, voice, statements or other likeness and DRAWING prize information in any media now known or hereafter devised, throughout the world, in perpetuity, without limitation and without additional compensation or consideration, notification or permission, unless prohibited by law.
G. GENERAL CONDITIONS: Released Parties are not responsible for printing or typographical errors in any DRAWING-related materials, or for stolen, late, misdirected, lost, damaged, garbled, delayed, incomplete, or inaccurate entries. DRAWING entries generated by a script, macro or other mechanical or automated means will be disqualified. The Lottery and each of its respective agents, released parties and representatives are not responsible for incorrect, inaccurate transcription or loss or delay of entry or prize reply information, or any viruses transmitted to computers of participants via the Internet, or for any technical or human errors associated with the DRAWING. If, in the exclusive judgment of the Lottery, this DRAWING becomes compromised in any way, the Lottery reserves the right to withdraw the offer, cancel any method of entry, to void any entries submitted fraudulently or select winners from all eligible entries received prior to act that compromised the DRAWING.
Persons who tamper with or abuse any aspect of the DRAWING or website or attempt to undermine the legitimate operation of the DRAWING by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or any of the Released Parties’ representatives or who are in violation of these Official Rules, as solely determined by the Lottery, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this DRAWING is unlawful and subject to legal action by the Lottery and the Released Parties. The Lottery shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the DRAWING, and to resolve all disputes in its sole discretion. Released Parties make no warranty, guaranty or representation of any kind concerning any prize, and disclaim any implied warranty. The Lottery’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. All disputes will be resolved under applicable laws in the County of Dane, State of Wisconsin. State of Wisconsin standard terms and conditions accessible via http://vendornet.state.wi.us/vendornet/doaforms/doa-3054a.doc (the “State of Wisconsin Standard Terms and Conditions”) are made a part of these Official Rules. To the extent that the terms of the State of Wisconsin Standard Terms and Conditions conflict with the terms of these Official Rules, the State of Wisconsin Standard Terms and Conditions shall control.
The Lottery, as applicable, reserves the right, in their sole discretion, to cancel or suspend the DRAWING (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the DRAWING (or any portion thereof). In the event of cancellation, the Lottery may elect to identify winners and award the DRAWING prizes by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation.
Any attempt by an entrant to deliberately damage any website or undermine the content or legitimate operation of this DRAWING is a violation of criminal and civil laws and should such an attempt be made, the Lottery will disqualify any such entrant and reserve the right to seek damages (including attorneys’ fees) and other remedies from any such entrant to the fullest extent permitted by law.
